Warranty
LIMITED WARRANTY and LIMITATION OF REMEDIES:
Sky Blue Technologies, Inc., (Sky Blue) warrants that the Radio Bookmark is free from defects in material and manufacture at the time of delivery to you. If any such defect appears while you remain a subscriber to the Radio Bookmark service via your local Public Radio station for which you originally received the Radio Bookmark, Sky Blue shall, at its option, either (a) repair, or (b) replace the Radio Bookmark. This warranty does not apply to failures of the Radio Bookmark resulting from, in Sky Blue’s opinion, misuse, abuse, accident, neglect or mishandling, opening the device or exposing the device to liquids of any kind. Sky Blue specifically disclaims any warranty of merchantability, fitness for a particular purpose, or non-interruption of use. Because the Radio Bookmark is only licensed to you for your personal enjoyment and not for any business or commercial purpose, you may not use the Radio Bookmark for business or commercial activity or seek relief against Sky Blue on any theory of indirect, special, incidental, or consequential loss or damage.
